Groundskeepers of Aspen Inc. hereafter referred to as GKoA
• Service Period: Our ‘season’ is defined as November 1, 2022 through (and including) April 15, 2023.
• Cancellation: Service may be cancelled prior to April 15 if requested in writing either by email, fax, or mail. Seasonal contracts must be
cancelled by December 25th in order to receive 50% refund. For cancellation beyond December 25th the amount of refund will be based
on the number of services provided vs. anticipated services in your area. GKoA reserves the right to cancel any contract or service at
any time.
• Snow Stakes: Service minimum $80 for installation and removal of snow stakes per season, invoiced when installed.
• Minimums: Unless otherwise specified, GKoA will provide service when there is snowfall of 3” or more for plowing and 1” or more for
shoveling. Snowfall totals are taken from a variety of sources but ultimately will be determined by GKoA.
• Time of Service: Regularly scheduled snow removal services will commence at 4:00 am or when snowfall has reached the minimum
depth level as defined above and will be completed by 8:00 am. Exceptions to completion time may be made in cases of a ‘Per Service Contract’ as defined below. In such cases service will be provided as soon as possible.
• Time and Material: Payment for a service or deliverable to be provided on a time-and-material basis shall be determined in accordance with the current hourly rates for services set forth by GKoA. The client agrees to pay GKoA a fixed hourly labor rate for everyone working on the job and a markup on materials not to exceed 35%.
• Per Service Contract: Cost for services proposed in the contract will be billed out at the appropriate per service rate. There is no cap or maximum amount of times GKoA will provide service. For continued snowfall throughout the day, GKoA may provide service multiple times and the appropriate per service rate would apply for each. *In cases where snowfall totals exceed 6” either overnight or during the date of service, GKoA reserves the right to charge double the normal per service rate.
• Additional Service: If conditions deteriorate and rock or gravel is displaced mid-season replacement of disturbed rocks will be billed at $65 per hour, per man after the Spring melt.
• Billing: Invoices will be sent on the final day of each month and payments due by the 10th of the following month. A credit card will be
required on file for all accounts that are not prepaid for the season. If unable to provide a credit card a deposit will
be required in an amount as determined by GKoA.
• Fuel Surcharge: A fuel/environmental surcharge will be added to each invoice and is based on the actual price of fuel within your service
area. The surcharge (currently 7.5%) will be reviewed each month and will be adjusted up or down accordingly. Since our costs are
largely dependent on fuel this allows us to offer the most competitive pricing.
• Property Damage: The owner/property manager will report, in writing, any damage caused by GKoA within 48 hours. GKoA will repair
any timely and properly reported damage in the spring season during the snow and ice management program season in which the
property damage occurred. Notwithstanding anything herein to the contrary, GKoA will have no obligation, and the owner waives any
damages for any property damage not timely and properly reported. No reimbursement will be provided for any repairs provided by any
other contractor other than GKoA.
• Limitation of Liability: While GKoA takes great care in protecting your landscape and property, we are unable to take responsibility for
any of the following: A) Damage to landscaping caused by the piling of snow B) General debris, loose paving materials, gravel or ice
being struck, lifted and displaced by snow removal equipment. C) Protrusions of any objects hidden by snow accumulation being struck
by snow removal equipment including but not limited to: sod, raised beds, plant material, interlock pavers, curbing, fencing, fixtures,
lawn ornaments, retaining walls, etc… D) Any damage whatsoever from snow removal equipment coming in contact with interlock,
flagstone, cobblestone or any other type of alternative paving surface. E) Damage caused by equipment when tree, shrub, and sidewalk
areas are not reasonably delineated due to snow accumulation. F) Damage/marks caused by chains, studs, plows, shovels, or any
other equipment. G) Personal injuries resulting from slip and fall accidents. H) Deterioration of property due to rock or gravel
displacement. Removing rocks or gravel will be an additional service/expense in the Spring and/or I) Acts of God, including but not
limited to extraordinary weather conditions.
• General Liability: Any liability on the part of of GKoA shall be limited only to any damage to the Client’s property or persons on the Client’s property at the time of the incident, and shall be further limited to only those losses or damages suffered by the Client, or persons on the Client’s property, as a result of the negligent actions of any authorized GKoA employee providing services on the Client’s property. GKoA, its owners & employees shall not be held liable for any losses suffered by the Client, or other persons on the Client’s property, as a result of any of the following: advice, suggestions or consultation given; with services provided by GKoA. Furthermore, GKoA, its owners & employees shall not be held liable for any losses suffered by the Client, or other persons on the Client’s property, for any of the following reasons: inconvenience, personal discomfort; temporary loss of use or enjoyment of the property or income loss experienced as a result of the Client’s decision to hire GKoA.
